Driving In The USA And Canada - Passing (Overtaking) On An Inside Lane

In most states it is perfectly legal to pass (overtake) other moving vehicles on an inside lane but I believe that the exact circumstances under which it is permitted vary between states.

It is not legal to pass a moving vehicle on an inside lane in Nebraska, North Dakota, Oklahoma or Tennessee.

I would suggest that the safest policy is as follows:

The California Driver Handbook 2002 (external link verified Jul-02) says: "You may pass on the right only on a highway clearly marked with two or more lanes for vehicles moving in your direction of travel, or if the driver ahead of you is making a left turn and you do not have to drive off the roadway." On busy multi-lane roads and freeways there can often be some doubt as to whether the different lanes are intended for vehicles moving at different speeds or for vehicles intending to turn in different directions at an upcoming intersection or exit.

When changing lanes always clearly signal your intention and check for vehicles intending to move into the same lane from the other side. For example, if you are intending to move from lane 3 to lane 2, check for vehicles intending to move from lane 1 to lane 2.
